Terms and Conditions

BALANCE OF PAYMENT

A Non-Refundable Deposit of $600.00 per person ('the Non-Refundable Deposit') is payable within seven days of making a booking. This amount will become part of the total price for the Travel Package ('the Total Price'). Failure to pay the Non-Refundable Deposit will automatically cause the cancellation of your Travel Package. However, should the requested reservation not be available this amount will be refunded in full. Payment of the Total Price must be made in full at least 90 days prior to tour departure unless otherwise specified ('the Deadline'). Live it Travel reserves the right to both cancel the Travel Package and impose cancellation fees should you fail to pay for the Travel Package by the Deadline.

CANCELLATIONS AND REFUNDS

If it becomes necessary to cancel your holiday you must notify us in writing immediately. Cancellation will take effect upon receipt and acknowledgement of your cancellation. Cancellation fees apply as following:

  1. If you cancel the Travel Package on the day which is 60 days or more prior to the date of departure, 15% of amount paid to date plus the Non-Refundable Deposit will be kept, all other monies will be refunded subject to supplier cancellation costs and the Directors Discretion;
  2. If you cancel less than 60 days prior to the date of departure then no refund can be made.

VISA, PASSPORT AND HEALTH

Live It Travel is not liable for any costs, expenses or losses incurred in relation to any issues relating to Visas, Passports, Vaccinations and Baggage. You agree that you are responsible for all visas, entry, health and other requirements and any documents required by laws, regulations, orders and or requirements of countries visited. To ensure the safety of all passengers, including you, you must disclose to Live It Travel any medical condition that you are suffering from.

EXCLUSIONS

Live It Travel is not liable for expenses, costs or losses incurred in relation to meals and beverages not otherwise detailed in the itinerary. Tips; transport in countries of visit unless detailed in the itinerary; excess baggage and airport taxes; passport and visa fees; insurances; expenses; fees and costs incurred in the case of illness or of refusal of entry, detention in or expulsion or repatriation from a country; telephone calls; and the cost and expenses incurred, including return trip home, should you leave the tour of your own volition or due to illness or reasons beyond Live It Travel's control. Extra meals, drinks, laundry, optional activities, individual events not listed as inclusions and any items of personal nature are also expressly excluded.

PRICES AND VALIDITY

Live It Travel reserves the right to pass on costs imposed by airlines for ticketing plus a service fee and GST. All bookings with suppliers of holiday components such as accommodation and sightseeing are subject to holiday suppliers' terms, conditions and liabilities.

TRAVEL INSURANCE

Please note that it is mandatory to take out comprehensive insurance cover for the entire duration of your holiday.

PRICE AND ITINERARY CHANGES

Live It Travel reserves the right to adjust and make changes to the Total Price at any time for reasons outside Live It Travel's control such as fluctuations in currencies and changes to suppliers' prices.

OUR TRIP AND ASSUMPTION OF RISK

Live it Travel operates in areas where standards of accommodation, transport, personal and public safety, hygiene and medical facilities and other infrastructure may at times not be of a standard you are used to at home. By booking with Live it Travel you acknowledge that participation in all our trips involves inherent risks and that you personally assume these risks whilst giving full indemnity to Live it Travel. These risks include, but are not limited to, the possibility of injury or death, psychological trauma, disease, loss or damage of property, discomfort and inconvenience.

EXCLUSION OF LIABILITY

Live it Travel arranges your Travel Package and provides you with bookings, arrangements, ticketing and other ancillary and related services. However Live It Travel does not itself provide the transport, accommodation, meals and other facilities ('Facilities') that you may receive on your holiday and Live It Travel specifically excludes any liability which may arise out of these Facilities. Live It Travel is not liable for cancellation of your Travel Package, deviations, delays or the failure to provide seat, berths or facilities for carrying or storing luggage or for the failure to provide accommodation, nor for the event of any alteration or change of any kind made in respect of travel services including increases in charges for which you will be required to pay for. Live It Travel does not accept any responsibility for any act, omission, default or neglect of it, its servants or agents, for death, injury, damage or loss to persons or goods whatsoever and howsoever caused; nor does it warrant and is in no way responsible for the accuracy of information given or statements made by its servants and or agents.

WAIVER, RELEASE AND INDEMNITY

In consideration of Live It Travel arranging the Travel Package you acknowledge and agree that:

  1. You are physically and mentally fit to engage in all the activities provided for in your Travel Package ('Activities') and that you will not be under the influence of any drug, alcohol or medications that are contraindicative of engaging in these Activities;
  2. You freely and voluntarily agree, forever, to release, discharge, waive and relinquish, favour of Live It Travel, any and all claims, demands, causes of action, whether matured or unmatured, foreseen or unforeseen, arising from, or in connection with, any of the Activities including, without limitation, those for or relating to accident, personal injury, theft, property damage and/or wrongful death occurring to you, arising out of, relating to, or as a result of your engagement in the Activities;
  3. You expressly assume, without any limitation, full responsibility for any and all risks of and actual suffering from bodily injuries, condition, ailment, sickness, heart attack, panic attack, hyperventilation, allergic reaction, animal attack or bite, animal, plant or chemical environomisation, wrongful death or property damage, now and forever, arising out of, or related to, or as a result of your participation in the Activities, whether foreseen or unforeseen, and whether caused by the negligence of Live It Travel, its servants and or agents or otherwise;
  4. You expressly agree to indemnify and keep indemnified, save and hold harmless Live It Travel and or its servants and agents from any loss, liability, damage or cost that might be incurred now and forever, arising out of, or related to, or as a result of your participation in the Activities and or any other related operations, whether caused by the negligence of Live It Travel or otherwise;
  5. That you understand that you have given up substantial rights by acknowledging the conditions of this document; that you are aware if its legal consequences, and have consented to it freely and voluntarily, without any inducement, assurance, or guarantee being made to you; and that you intend this acknowledgement to be a complete and unconditional release of all liability, to the greatest extent allowed by law.

RESPONSIBILITY

(Please read carefully) Your booking is only valid with Live It Travel upon Live It Travel receiving a signed and completed Booking Form. By my signature as set forth on the booking form I also acknowledge and confirm the following. I waive any and all claims, now and in the future against, and release from all Liability and agree to not sue Live It Travel and its officers, employees, guides, agents or representatives or licensor for any personal injury, death, property damage, or loss sustained as a result of your participation in a trip with Live It Travel, due to any cause whatsoever, including without any limitation, negligence or the part of Live It Travel, its staff or licensor. I agree that if I suffer injury or illness, Live It Travel can, at my cost arrange medical treatment and emergency evacuation services, as Live It Travel deems essential for my safety. In entering in this agreement, I am not relying on any oral, written or visual representation or statement by Live It Travel or its staff or any other inducement or coercion to go on this trip, hence only of my own free will.
